The mystery of time has been examined in songs by everyone from Cyndi Lauper to REM and from Enya to Cher. It has been explored in classic movies such as "Groundhog Day" and "Back to the Future" and in books such as H.G. Wells' "The Time Machine."

The familiar elusiveness of time wraps around all of our days, figuring prominently in most aspects of life. All of this leads up to a deadline no one who has been the victim of negligence by a doctor should ignore: here in Kentucky, as well as in Ohio, you have exactly one year in which to file a medical malpractice lawsuit.

The year begins when you discover the injury. Let's say you have undergone surgery, but find that you continue to suffer symptoms afterwards. A year after the initial surgery, you undergo another operation. In the second surgery it is found that the initial surgeon left a sponge inside you. The sponge and resultant infections are what caused your post-surgery symptoms.

So the clock on a medical malpractice claim would begin with the discovery of the sponge, rather than when the initial surgery took place. In this example, you might well have a good and reasonable claim to make against the negligent initial surgeon. But if you don't file a claim within that year, your claim might well never be heard by a court. Allowing that hard deadline to pass might end your chances of compensation for your damages.
